Privacy Policy

Christopher J. Stasuik, Chartered Accountant (“CJS”) is committed to respecting your personal information and its confidentiality.  The privacy policy of CJS applies to the collection, use and disclosure of personal information in the course of its activities.  This policy has been written to conform to the Personal Information Protection and Electronics Documents Act (“PIPEDA”).

CJS also follows and conforms to the rules of professional conduct of the Institute of Chartered Accountants of Ontario (ICAO) and ensures it meets the related council interpretations of that provincial institute.  Among other things, these rules ensure:

  • Partners and staff maintain the confidentiality of client and former client information.
  • Partners and staff maintain confidentiality of the firm information.
  • Partners and staff do not use confidential information for personal advantage, for the advantage of a 3rd party or to the disadvantage of a client or former client of the firm.

CJS reserves the right to modify the terms and conditions of this Privacy Policy at any time, and such modifications shall be effective immediately, unless otherwise noted.

CJS adheres to the ten principles of PIPEDA as described below.

Principal 1 - Accountability

An appointed Compliance Officer is responsible for all privacy policies and their enforcement within business conducted by CJS.  Other CJS staff may be responsible for the collection and processing of information in the course of daily business.  Additionally the Compliance Officer may, from time to time, delegate other individuals to act on behalf of the Compliance Officer.

CJS is responsible for personal information in its possession and custody and any information that has been transferred to a 3rd party.  Personal information will not be disclosed to any third party unless the recipient has legally committed to or has a privacy policy comparable to CJS that protects personal information.

CJS has implemented policies and practices that give effect to the principals defined in this policy.  These include but are not limited to:

Procedures to protect personal information.

Procedures to respond to complaints and inquiries.

Procedures to train and communicate to staff CJS policies and practices.

Principal 2- Identifying Purposes

CJS will identify the purpose for which personal information is collected previous or at the time of collection.  Personal information collected, used or disclosed shall only be that information necessary as specified by the purposes that have been identified.
If personal information collected is to be used for a purpose not previously identified, the new purpose will be identified to the appropriate individual prior to its use, expect as permitted by law.

Principal 3- Consent

Prior to, or at the time of, collection of personal information, CJS will obtain consent of the individual for the collection of the personal information and its subsequent use or disclosure.  Any new or previously unidentified purpose for the use or disclosure of personal information by CJS will require new consent from the individual except where not required to do so by law.

CJS will make reasonable effort to ensure that an individual making consent understands the purpose to which their personal information will be used or disclosed.  Consent may be express or implied consent, dependent on the nature of the circumstances or use or the type of information.  In determining the form of consent, CJS will take into account the sensitivity and nature of the information and reasonable expectations of the individual.  CJS will not, as a condition of the supply of a product of a service, require an individual to consent to the collection, use or disclosure of information beyond that which is expressly required to fulfill the specified and legitimate purposes.

Personal information will only be used or disclosed without consent, where permitted or required by law.

Individuals may withdraw their consent at any time, subject to legal or contractual obligations and reasonable notice.  CJS will inform the individual of any implications of the withdrawal of such consent.


Principal 4- Limiting Collection

Collection of personal information shall be limited to that information that is necessary for the purposed identified.  Personal information shall only be collected by fair and lawful means and for purposed that a reasonable person would consider appropriate for the circumstances.

Principal 5 - Limiting Use, Disclosure and Retention

Personal information collected shall not be used or disclosed for purposes other that those for which it was collected, except with consent of the individual or as permitted or required by law.  CJS ensures that only those employees or 3rd parties with operational duties in the fulfillment of an individual’s services will have access to the individual’s personal information.

Personal information shall only be retained by CJS as long as necessary per the firm’s policies for information retention and destruction.  Legal or regulatory requirements may affect the specific time particular personal information is kept or destroyed.

Principal 6- Accuracy

An individual’s personal information, as managed by CJS, shall be as accurate, up to date and complete as necessary to fulfill the identified purpose of its use.  CJS will make reasonable efforts to ensure that personal information is sufficiently accurate, complete and up to date.  CJS will not routinely update personal information, unless it is necessary to fulfill the purposes for which the information was collected and consent obtained.

Principal 7- Safeguards

All personal information collected by CJS will be safeguarded against loss or theft as well as unauthorized access, disclosure, copying or misuse.  The nature of safeguards used to protect personal information will vary dependant of the sensitivity of the personal information collected, the amount of information collected, and the format of information collected.

The methods of protection used by CJS include but are not limited to:

Physical measures (locked filing cabinets, restricted access offices)

Organizational Measures (information access and security policies and clearances)

Technological (use of encryption technology, passwords, virus and malware checkers)

Principal 8- Openness

The privacy policies and practices that apply to CJS’ management of personal information shall be made readily available to clients and employees of CJS.  Any questions or inquires related to this privacy policy or the information management of CJS will be referred to the company Compliance Officer.

Principal 9- Individual Access

Upon request to CJS, an individual may be given reasonable access to their personal information and may correct any such personal information if its accuracy and completeness is found to be deficient and material.  In addition an individual shall, upon request, be informed of the existence, use or disclosure of their personal information by CJS.  CJS will respond to access requests within a reasonable timeframe and will reasonably ensure that requests for information are met except where access is not required by law.

Further exception to providing an individual with specific access to their personal information includes but is not limited to: information that contains reference to other individual’s personal information, information that cannot be disclosed for legal, investigative, security or commercial proprietary reasons, information that is subject to solicitor-client or litigation privileges.

Principal 10- Recourse to Compliance

The CJS Compliance Officer is responsible for all enquiries about the CJS privacy policy and personal information management related to CJS.  CJS will inform individuals who make complaints or inquiries concerning CJS personal information management about complaint procedures.  CJS will investigate all complaints.  If complaint is found to be justified, CJS will take appropriate measures, including, if necessary, amending its policies and practices.
